Terms of service

These terms govern the use of Lacima, a service operated by Lacima SAS (informations provisoires) (SAS), registered under number 000 000 000 R.C.S. Paris, with its registered office at 1 rue de l'Exemple, 75001 Paris, FR.

1. What the service does

Lacima phones a person you nominate on a regular basis, talks with them in their own language through a voice assistant called Marie, keeps a memory from one call to the next, can take their incoming calls, and emails you an account of how it went.

2. What the service is not

These limits are substantive, not boilerplate:

• It is not a medical device. Marie makes no diagnosis and gives no medical advice.
• It is not an emergency service. We never alert emergency services automatically. If the person

needs immediate help, call your emergency number yourself.

• It is not a monitoring system. There is no continuous listening.
• It does not replace human presence, and we will never present it as if it did.

Marie states that she is an artificial intelligence in her first sentence, on every call. She never presents herself as a person, a relative, a clinician or an official. She never asks for a password, a code or a card number, and starts no financial transaction.

3. Your account

You must be an adult and provide accurate information. You are responsible for keeping your access confidential and for what is done from your account.

A household may have several members with distinct roles. The household owner decides who joins and who can see what.

4. The person you call: your most important undertaking

You may only enrol a person if:

1. you have told them what Lacima is and what it does;
2. they have consented to being called;
3. you are entitled to give us their number and the information you enter.

You attest to that consent when enrolling, and the attestation is recorded with your name. If you cannot obtain it, do not enrol the person.

If the person called asks for the calls to stop — whether they tell us or tell you — the calls stop. Their wishes prevail over yours, including where you pay the subscription.

5. What you must not do

• Enrol a person without their consent.
• Use the service to monitor someone without their knowledge.
• Use the summaries in a way that would work against the person called.
• Attempt to circumvent technical limits, quotas or security measures.
• Resell access to the service.

6. Subscription, price and cancellation

Plans and prices are those shown at https://lacima.net-innovation.com at the time of subscribing. The subscription renews automatically for the same term unless cancelled before it ends.

You may cancel at any time from your account; the service runs until the end of the paid period. If a payment fails we do not cut the calls off immediately: stopping an older person's daily call because a card expired would be poor service. We tell you first.

As a consumer you have a fourteen-day right of withdrawal. By requesting immediate performance of the service you accept that this right is extinguished as the service is performed.

7. Availability

We do what is needed to keep the service running, without guaranteeing uninterrupted availability. A call can fail for reasons outside our control: an engaged line, an unavailable network, a carrier outage. A missed call is not a defect in the service, and must never be read as a sign that the person is well or unwell.

8. Liability

Lacima is a companionship service. We cannot be held liable for harm arising because a situation was not detected, not reported, or reported late. The service replaces neither medical supervision, nor a personal alarm system, nor the attention of relatives.

Our liability is limited to the amounts actually paid over the preceding twelve months, so far as the law permits. Nothing in these terms excludes liability that cannot lawfully be excluded.

9. Personal data

Data processing is described in the privacy policy, which forms part of these terms.

10. Ownership

The service, its code and its content belong to us. Your household's data belongs to you, and you may request an export of it.

11. Changes

We may change these terms. Any substantive change is notified to you before it takes effect. Continuing to use the service after that date constitutes acceptance.

12. Governing law

These terms are governed by the law of the country of Lacima SAS (informations provisoires)'s registered office. Failing an amicable settlement, the competent courts of that jurisdiction have exclusive jurisdiction, without prejudice to protective rules applicable to consumers.
